End User License Agreement

1. Agreement

This End User License Agreement ("EULA") is a legal agreement between you and Yoga Hours ("we," "us"), the developer of the Yoga Hours mobile application (the "App"). It is not an agreement with Apple Inc. ("Apple") or Google LLC ("Google"). By downloading, installing, or using the App you agree to this EULA, to our Terms of Use, and to our Privacy Policy, both of which are incorporated by reference. If this EULA conflicts with the Terms of Use, this EULA governs your use of the App itself.

2. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App for your personal, non-commercial use on devices that you own or control, as permitted by the usage rules of the app store from which you obtained it (the Apple App Store Terms of Service, including its Licensed Application usage rules, or the Google Play Terms of Service).

3. Restrictions

You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works of the App; reverse engineer or attempt to extract its source code except to the extent such restriction is prohibited by applicable law; or use the App in violation of the Acceptable Use provisions of the Terms of Use.

4. Subscriptions

Optional premium subscriptions are described in the Terms of Use and are billed by Apple or Google, not by us. Prices, renewal, and cancellation are governed by the store's own terms and your store account settings.

5. Your Content

You retain ownership of the information you record in the App (teaching and practice hours, class flows, notes, and similar content). Our collection and handling of personal data is described in the Privacy Policy.

6. Maintenance and Support

We are solely responsible for the App and for providing any maintenance and support for it. Apple and Google have no obligation whatsoever to furnish any maintenance or support services for the App. Questions, complaints, and claims regarding the App should be directed to us at hello@yogahours.com.

7. Warranty

The App is provided "as is" and "as available," without warranties of any kind, express or implied, to the maximum extent permitted by applicable law. Nothing in this EULA limits non-excludable statutory warranties or guarantees that apply in your jurisdiction. If the App was obtained from the Apple App Store and fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any) to you; to the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are our responsibility.

8. Product Claims

We, not Apple or Google, are responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including (i) product liability claims; (ii) any claim that the App fails to conform to an applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. The App is a record-keeping tool; it is not certified by, affiliated with, or a guarantee of acceptance by any yoga certification body.

9. Intellectual Property Claims

In the event of any third-party claim that the App, or your possession and use of the App, infringes that third party's intellectual property rights, we, not Apple or Google, are solely responsible for the investigation, defense, settlement, and discharge of that claim.

10. Legal Compliance

You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

11. Third-Party Terms

You must comply with applicable third-party terms of agreement when using the App (for example, your wireless carrier's data agreement).

12. Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance of it, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

13. Termination

This EULA is effective until terminated. It terminates automatically if you fail to comply with its terms; you may terminate it at any time by deleting the App and your account. Sections 5 and 7 through 12 survive termination.

14. Consumer Rights

Nothing in this EULA excludes, restricts, or modifies any consumer right or remedy that cannot be excluded, restricted, or modified under the laws of your country of residence, including under EU and UK consumer protection law and the Australian Consumer Law.

15. Governing Law

This EULA is governed by the laws of the State of Tennessee, United States, without regard to conflict-of-law principles, except that if you are a consumer resident outside the United States, you also benefit from any mandatory provisions of the law of your country of residence.
